Tesla Insurance, the insurance branch of the car manufacturer, is facing an unusual lawsuit in California.
The lawsuit was filed by a North Hollywood resident, Carlos Magana, who accuses Tesla of failing to process his compensation claim within the legal time limits. Filed on July 11 in the Los Angeles County Superior Court, the complaint could turn into a class action involving other insured individuals facing similar delays.
According to the complaint, Magana’s vehicle, a 2024 Dodge Ram, was stolen on January 2, 2025. Despite filing a police report and promptly notifying Tesla Insurance, the insured claims he received no concrete response within the timeframes required by California law. This law requires insurers to start their investigation within 15 days, make a decision within 40 days, and issue a payment within the following 30 days.

Magana claims he received no compensation by the deadline of March 13. He states that he waited up to three hours on the phone without ever speaking to a representative and received contradictory responses from Tesla’s teams. On March 30, after 87 days of waiting, he was forced to fund a new vehicle himself.
